These terms and conditions apply when you use our website and purchase products from Tiger Lily Art.

 

By placing an order with us, you agree to these terms. Please read them carefully before making a purchase and keep a copy for your records.

Nothing in these terms affects your statutory rights as a consumer.

Tiger Lily Art specialises in decorative, antique, vintage and other works of art, including prints, engravings, natural history subjects and framed artworks.

 

Products and Artwork

Many of the works offered by Tiger Lily Art are antique, vintage, pre-owned or individually sourced pieces.

 

Unless stated otherwise, individual artworks are generally unique and only one example is available.

The age, history and handmade nature of many works mean that variations and signs of age are to be expected and form part of their character.

 

We aim to describe every item as accurately and clearly as reasonably possible.

 

Artwork Descriptions, Condition and Age

Antique and vintage artwork may show signs consistent with its age and history.

 

These may include, where appropriate:

  • toning or discolouration of paper;

  • foxing;

  • fading;

  • minor marks or staining;

  • creases or paper irregularities;

  • plate marks;

  • historical repairs or restoration;

  • small imperfections to mounts or frames; and

  • other age-related characteristics.

 

Where we are aware of a material defect or condition issue that we believe would reasonably affect a purchasing decision, we will aim to identify this in the product description or accompanying photographs.

 

Normal age-related characteristics should not necessarily be regarded as defects where they are consistent with the description, age and nature of the item.

 

Nothing in this section limits your statutory rights where goods are faulty, materially misdescribed or otherwise fail to meet the requirements of applicable consumer law.

 

Attribution, Dating and Provenance

Information regarding an artwork's artist, engraver, publisher, subject, period, date, origin or provenance is provided in good faith and based upon the information reasonably available to us at the time of listing.

 

Where a description uses wording such as:

  • attributed to;

  • after;

  • school of;

  • circle of;

  • in the manner of;

  • circa;

  • probably; or

  • believed to be;

this indicates that a degree of judgement or uncertainty is involved.

 

Unless expressly stated otherwise, such descriptions should not be treated as a formal independent authentication or guarantee of authorship, date or provenance.

 

Any specific certificates, supporting documentation or provenance supplied with an artwork will be identified in its product description where appropriate.

 

Images, Colours and Dimensions

 

We take reasonable care to ensure that photographs represent our products accurately.

 

However, colours, contrast, paper tone and other visual characteristics may appear differently depending upon:

  • lighting when the artwork was photographed;

  • photographic reproduction;

  • your computer, tablet or mobile screen; and

  • individual display settings.

 

For this reason, minor differences between an on-screen image and the physical artwork are possible.

 

Dimensions are provided as accurately as reasonably possible but may be approximate, particularly for antique works and frames.

 

Where relevant, we will aim to make clear whether dimensions refer to the artwork, image area, mount or overall framed size.

 

Frames and Presentation

Where an artwork is supplied framed, the frame forms part of the product unless stated otherwise.

 

Frames may be antique, vintage, previously used or contemporary. Older frames may display wear, minor marks, restoration or other signs consistent with their age.

 

Where a frame is of particular importance, for example where we believe it is original or period, we will aim to state this in the product description.

Unless expressly stated, we do not guarantee that an existing frame is contemporary with the artwork.

 

Ordering

You may place an order through our website using the checkout process provided or, by prior agreement with us, by an appropriate email to us.

 

You are responsible for ensuring that the information supplied when ordering is complete and accurate.

 

After placing an order, you should receive an acknowledgement confirming that we have received it.

Our acceptance of your order takes place when we send confirmation that the order has been accepted and/or dispatched, at which point a contract is formed between you and Tiger Lily Art.

 

We reserve the right not to accept an order, including where:

  • an item has already been sold;

  • there is an error in price or description;

  • we are unable to obtain authorisation for payment;

  • payment has not been received by us into our bank account;

  • delivery to the requested location is not possible; or

  • we reasonably suspect fraudulent or unauthorised activity.

If payment has already been taken and we cannot accept your order, we will refund the amount paid.

 

Prices and Payment

Prices shown on our website are in pounds sterling unless stated otherwise.

 

Prices will include VAT where applicable.

 

Delivery and insurance charges, where applicable, will be displayed before your order is completed or otherwise agreed with you.

 

Payment must be made using one of the payment methods offered during checkout or, by prior agreement with us, direct to our bank account.

 

We may change prices at any time, but this will not affect an order that we have already accepted.

Availability and One-Off Works

Because many artworks are unique, availability can change quickly.

 

Although we take reasonable steps to keep the website up to date, an item may occasionally be sold through another channel shortly before an online order is placed.

 

If this occurs, we will contact you and provide a full refund.

 

We are not obliged to supply an alternative artwork.

 

Changes to Orders

If you wish to change an order after placing it, please contact us as soon as possible.

 

We will let you know whether the requested change is possible and whether it affects the price or delivery arrangements.

 

Once an artwork has been dispatched, or work has commenced on a bespoke service, it may no longer be possible to make changes.

 

Delivery

Delivery charges and available delivery options will normally be shown during checkout or agreed separately.

 

Because artworks may be fragile, valuable or unusually sized, we may use specialist packaging or delivery services where appropriate.

 

Estimated delivery dates are estimates unless we expressly agree otherwise.

 

Where circumstances outside our reasonable control cause a delay, we will contact you and provide an updated estimate.

 

Ownership of the goods passes to you once we have received payment in full.

Risk in the goods passes to you when the goods have been delivered to you, or to a person identified by you to receive them.

 

Damage in Transit

Please inspect your delivery as soon as reasonably practical after it arrives.

 

If an artwork or frame appears to have been damaged during delivery, please contact us promptly.

 

Where possible, please:

  • retain the packaging;

  • photograph the packaging before disposing of it;

  • photograph any visible damage to the artwork or frame; and

  • provide your order details.

 

This helps us assess the damage and, where appropriate, pursue a claim with the carrier.

 

These requests do not affect your statutory rights.

 

Cancellation and Returns

If you are a consumer purchasing online, you will normally have a legal right to change your mind and cancel your purchase within 14 days after receiving the goods, subject to the exceptions provided by law.

 

You do not need to give a reason for cancellation.

 

To exercise this right, you must tell us clearly that you wish to cancel within the cancellation period.

 

You will then normally have a further 14 days to return the goods.

 

Unless the item is faulty, damaged, misdescribed or we agree otherwise, you will be responsible for the cost of returning it, including insurance costs.

 

You must take reasonable care of the artwork while it is in your possession.

 

You may inspect the item in a similar way to how you could reasonably examine it in a shop. We may make an appropriate deduction from a refund where handling beyond what is reasonably necessary has reduced the item's value, where permitted by law.

 

Where a cancellation right applies, we will refund the price paid, excluding, unless required by law, any delivery or insurance charges.

 

Subject to us receiving from you the artwork in the same condition as despatched by us, refunds will be made in accordance with the applicable statutory timescales.

 

Bespoke and Made-to-Order Work

Some products or services may involve work undertaken specifically for you.

 

This may include, depending upon the circumstances:

  • bespoke framing;

  • specially sourced frames or mouldings;

  • custom mounts;

  • unusual dimensions;

  • personalised presentation; or

  • other work produced to a customer's particular specification.

 

Certain genuinely bespoke or personalised goods may be excluded from the normal statutory right to cancel once ordered.

 

However, merely selecting from standard options does not necessarily make an item legally bespoke.

 

Where we believe your order contains work for which the normal cancellation right will not apply, we will aim to make this clear before the order is confirmed.

 

Your statutory rights remain unaffected where bespoke goods or services are faulty, misdescribed or have not been provided with reasonable care and skill.

 

Faulty or Misdescribed Goods

We have a legal duty to supply goods that conform to the contract.

 

Goods must, where applicable, be:

  • as described;

  • of satisfactory quality; and

  • fit for their intended purpose.

 

The assessment of satisfactory quality will take account of relevant circumstances, including an artwork's age, description, condition and price.

or example, age-related characteristics clearly described before purchase would not ordinarily be treated in the same manner as an undisclosed material defect.

 

If you believe an item is faulty or materially different from its description, please contact us with your order details.

Nothing in these Terms and Conditions restricts your statutory consumer rights.

 

Our Right to Cancel

We may cancel an order before completion where, for example:

  • an artwork is no longer available;

  • there has been a material pricing or description error;

  • we cannot reasonably deliver the product;

  • circumstances outside our reasonable control prevent us fulfilling the order; or

  • we reasonably believe the transaction to be fraudulent or unlawful.

 

If we cancel an order after receiving payment and no goods have been supplied, we will provide a full refund.

 

Intellectual Property

Unless stated otherwise, the content of our website, including text, photography, branding, graphics and website design, belongs to Tiger Lily Art or is used with permission.

 

You may view and use the website for your own personal, non-commercial purposes.

 

You may not reproduce, republish, commercially exploit or distribute our website content without permission, except where permitted by law.

 

Purchase of an artwork does not automatically transfer copyright or other intellectual property rights in that artwork unless expressly agreed in writing.

 

Our Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability that cannot legally be excluded under consumer protection law.

 

If you are purchasing as a consumer, we are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

 

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

 

We supply products through our consumer website for private use. Unless expressly agreed otherwise, we will not be liable for business losses arising from a consumer purchase.

 

Events Outside Our Control

We are not responsible for delays or failures caused by events outside our reasonable control.

 

These might include transport disruption, carrier delays, severe weather, fire, flood, industrial disputes, failures of utilities or communications networks, or other events we could not reasonably prevent.

If such an event materially affects your order, we will contact you and take reasonable steps to minimise the effect.

 

Your legal rights in relation to significant delays remain unaffected.

 

Changes to These Terms

We may update these Terms and Conditions from time to time, for example to reflect changes in our business, website or applicable law.

 

The terms applying to an order will normally be those in force when that order was placed.

 

The latest version will be available on our website.

 

Law and Jurisdiction

These terms are governed by English law.

 

If you are a consumer resident elsewhere in the United Kingdom, you will continue to benefit from any mandatory protections provided by the laws applicable where you live.

 

You may bring legal proceedings in the courts available to you under applicable UK consumer law, including the courts of England and Wales, Scotland or Northern Ireland where appropriate.
